These Customer Terms & Conditions ("Terms") apply when you use Admitix to browse events, make a booking, purchase tickets or make any other payment through the Admitix platform.
By purchasing a ticket or otherwise using Admitix's ticketing services, you agree to these Terms, our Privacy Policy, and any additional terms and conditions displayed by the Event Organiser for the relevant event.
1. About Admitix
Admitix provides an online ticketing and payment platform for event organisers.
When you purchase a ticket through Admitix, Admitix acts as the ticketing agent for the person or organisation responsible for the event ("Event Organiser").
Unless Admitix is expressly identified as the Event Organiser, the contract for attendance at the event is between you and the Event Organiser.
The Event Organiser is responsible for the event itself, including its content, performers, venue, scheduling, admission requirements and delivery.
Admitix provides the technology used to facilitate the booking, issue tickets and process or facilitate payments and refunds.
2. Event-specific terms
Event Organisers may apply additional terms and conditions to their events.
These may include conditions relating to age restrictions; admission and identification; ticket transfers; refunds; prohibited items; venue rules; event-specific conditions; and health or safety requirements.
Any additional Event Organiser terms will be made available as part of the booking process where applicable.
If an Event Organiser's terms conflict with these Terms or with rights you have under New Zealand law, those terms will apply only to the extent that they can lawfully do so.
3. Ticket purchases
You are responsible for checking the details of your booking before completing your purchase, including the event; date and time; venue; ticket type; quantity; price; and any applicable restrictions.
Once payment has been successfully completed, Admitix will issue confirmation of your booking and, where applicable, electronic tickets.
You must provide accurate and complete information when making a booking.
4. Ticket prices and fees
The total amount payable will be displayed before you complete your purchase.
The total may include the ticket price set by the Event Organiser; Admitix booking or service fees; payment processing charges; and any other clearly disclosed charges applicable to the booking.
Admitix does not generally determine the face value of tickets. Ticket prices are set by the Event Organiser.
No undisclosed compulsory charges will be added after you have confirmed your purchase.
5. Payment
Payments may be processed by Admitix or by a third-party payment provider acting on behalf of Admitix or the Event Organiser.
You must be authorised to use the payment method supplied.
A booking is not confirmed until payment has been successfully processed.
If a payment is declined, reversed, disputed, charged back or otherwise fails, Admitix or the Event Organiser may cancel the associated ticket where legally permitted.
6. Your tickets
Your ticket provides the holder with the right to seek admission to the specified event, subject to these Terms, the Event Organiser's terms and any applicable venue conditions.
You are responsible for keeping your ticket and any associated QR code or barcode secure.
A ticket may be refused if it has been cancelled or refunded; is fraudulent; has been duplicated; has already been used; was obtained unlawfully; or is otherwise invalid.
Where multiple copies of the same valid ticket are presented, the first ticket successfully scanned may be treated as the valid ticket.
7. Admission to events
Admission remains subject to the Event Organiser's and venue's reasonable conditions of entry.
An Event Organiser or venue may refuse admission or remove a person where reasonably necessary, including for intoxication; threatening or abusive behaviour; failure to comply with lawful safety requirements; possession of prohibited items; or a material breach of the event or venue conditions.
Nothing in this section permits an Event Organiser or venue to act unlawfully or override rights that cannot legally be excluded.
8. Refunds
Refund entitlement depends on the reason for the refund, the Event Organiser's terms and your rights under New Zealand law.
In most cases, the Event Organiser is responsible for deciding whether a discretionary refund is available, and Admitix facilitates an approved refund through the platform.
Nothing in these Terms limits any refund or other remedy you are legally entitled to receive.
Cancelled events
If an event is cancelled and is not rescheduled, you will be entitled to a refund where required by law.
For an ordinary cancelled event, this will generally mean a refund of the amount paid for the booking, including applicable booking fees.
Refunds will normally be returned to the payment method used for the original purchase.
Postponed or rescheduled events
If an event is postponed or rescheduled, your ticket will normally remain valid for the replacement date.
If the new date does not reasonably suit you, you may be entitled to request a refund depending on the Event Organiser's terms, the circumstances of the change and your rights under New Zealand law.
The Event Organiser will communicate the available options where reasonably practicable.
Venue changes
If an event is moved to another venue, tickets will normally remain valid.
If the venue change is substantial and materially changes what you purchased, you may have a right to a refund or another remedy.
If you can no longer attend
Tickets are not automatically refundable because you change your mind; become unavailable; mistakenly purchase a ticket; have a change in personal circumstances; or otherwise decide not to attend.
An Event Organiser may choose to provide a refund, exchange, credit or ticket transfer at its discretion.
This does not affect any legal right you may otherwise have to a remedy.
9. Changes to an event
Event details may occasionally change after tickets have been sold. This may include changes to performers; supporting acts; schedules; running times; event programmes; or other event details.
A minor change will not ordinarily give an automatic right to a refund.
If a change substantially alters the event you purchased, you may have rights to a refund or other remedy under the Event Organiser's terms or New Zealand consumer law.
Representations made about events must not be false or misleading. New Zealand's Fair Trading Act applies to promoters, ticket sellers and Event Organisers.
10. Events outside reasonable control
An event may be affected by circumstances outside the reasonable control of Admitix or the Event Organiser. These may include severe weather; natural disasters; fire; flooding; earthquakes; epidemics or pandemics; government restrictions; civil emergencies; failure of essential infrastructure; or other circumstances that could not reasonably have been prevented.
Where this occurs, the remedies available to you may depend on the circumstances, applicable Event Organiser terms and New Zealand law.
Nothing in this clause removes a right or remedy that cannot lawfully be excluded.
11. Ticket transfers and resale
Whether tickets may be transferred or resold is determined by the Event Organiser and any applicable law.
You must not create counterfeit tickets; duplicate tickets for use by multiple people; alter tickets; obtain tickets through fraudulent means; or resell tickets where resale is prohibited by law or by valid event conditions.
Some events declared under the Major Events Management Act 2007 may be subject to additional restrictions on ticket resale.
Admitix is not responsible for tickets purchased through unauthorised third-party resale channels.
12. Booking and pricing errors
Occasionally an obvious technical, pricing or inventory error may occur.
Where a ticket has been issued as the direct result of an obvious error, Admitix or the Event Organiser may cancel the affected transaction and provide a full refund.
We will not use this provision to retrospectively change a correctly advertised and completed sale.
13. Event Organiser responsibility
Unless Admitix is itself named as the Event Organiser, the Event Organiser is responsible for delivering the event.
Questions or complaints concerning matters such as performers, venue facilities, event operation, postponement or cancellation should generally be directed to the Event Organiser first.
Admitix may assist with communications or the processing of an approved refund but does not control the operation of independently organised events.
14. Admitix services
Admitix is responsible for providing its ticketing services with the level of care and skill required by applicable law.
We do not guarantee that the website or ticketing system will be uninterrupted or error-free at all times.
If a technical problem materially affects your booking, contact us and we will take reasonable steps to investigate and resolve the issue.
15. Liability
To the maximum extent permitted by law, Admitix is not responsible for loss arising solely from the acts or omissions of an independent Event Organiser, venue or other third party outside Admitix's reasonable control.
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
In particular, these Terms do not exclude rights or remedies available under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other legislation that cannot lawfully be contracted out of in a consumer transaction.
16. Privacy
Personal information collected through Admitix is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.
Information reasonably required to administer your booking may be provided to the relevant Event Organiser.
Any use of your information for marketing purposes will be subject to the permissions you have provided and applicable law.
17. Communications
By purchasing a ticket, you agree that Admitix and the Event Organiser may contact you where reasonably necessary regarding your booking or event.
These communications may include booking confirmations; tickets; important event information; venue changes; postponements; cancellations; safety information; and refund information.
Transactional communications relating to a ticket you purchased are separate from optional marketing communications.
18. Requesting a refund or raising a problem
For event-related refund requests, you should contact the Event Organiser where their contact information has been provided.
You may also contact Admitix at [email protected]
Please provide your name; order number; event name; affected ticket or tickets; and the reason for your request.
Where Event Organiser approval is required, Admitix may refer the request to the Event Organiser.
Approved refunds will normally be returned to the original payment method.
After a refund has been processed, your bank or payment provider may take additional time to make the funds available.
19. Consumer rights
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.
Consumers purchasing tickets in New Zealand may have rights under legislation including the Consumer Guarantees Act 1993, Fair Trading Act 1986, and Contract and Commercial Law Act 2017.
Ticket sellers, promoters and venues are required to comply with applicable consumer guarantees, and contractual terms cannot override rights that the law makes mandatory.
20. Changes to these Terms
Admitix may update these Terms from time to time, including to reflect changes to our services or applicable law.
The version applying to a ticket purchase will generally be the version presented or available when the booking was made, except where a later change is required by law or provides additional rights to the customer.
21. Governing law
These Terms are governed by the laws of New Zealand.
Any dispute relating to these Terms or the Admitix services will be subject to the jurisdiction of the New Zealand courts and tribunals.
